AAIS BUSINESSOWNERS POLICY AVAILABLE ENDORSEMENTS AND THEIR USES

INTRODUCTION

This list identifies endorsements available to modify the American Association of Insurance Services (AAIS) Businessowners Policy. It is arranged by form number and title and briefly describes and explains how each endorsement is used. It does not include any state specific endorsements, changes, or amendments. New endorsements and changes introduced with or after the BP 0816–Policy Amendatory Endorsement 01 15 edition are in bold print.

FORM NUMBERING

The ten-digit numbering sequence of AAIS forms and endorsements has a very specific meaning:

AAIS BUSINESSOWNERS POLICY ENDORSEMENTS

BP 0302–Burglary and Robbery Coverage

(Use with BP 0100)

This endorsement covers loss or damage to covered business personal property that results from actual or attempted burglary or robbery. This is a limited version of the Burglary and Robbery Optional Coverage in BP 0100–Businessowners Standard Policy. It is subject to sub-limits and property limitations and does not cover money and securities.

BP 0304–Money and Securities Coverage

(Use with BP 0100)

This endorsement covers losses to money, securities, and lottery tickets not held for sale caused by theft, disappearance, or destruction. Coverage applies to property inside the premises and while outside the premises with messengers. There must be limits for coverage inside the premises and outside the premises on the endorsement schedule.

BP 0306–Theft Coverage

(Use with BP 0100)

This endorsement covers loss or damage to covered property that results from attempted or actual theft at the described premises. Covered property does not include money and securities. Certain property is subject to sub-limits.

BP 0307–Additional Insured–Owner or Lessor of Leased Land

This endorsement adds the scheduled party from whom the named insured leases land as an additional insured. However, coverage applies to only the lessor’s liability that arises out of the named insured's use of the land described on the endorsement schedule.

BP 0309–Coverage Limitation–Designated Premises or Project

This endorsement restricts coverage. It limits the liability coverage the Businessowners Policy provides to only the premises or project on the endorsement schedule.

BP 0317–Condominium Buildings Exclusion–Entire Units

This endorsement excludes coverage on fixtures, improvements, and alterations that individual unit-owners solely own. This exclusion does not apply to such items that all unit-owners own jointly.

BP 0318–Condominium Buildings Exclusion–Improvements

This endorsement excludes coverage on fixtures, improvements, and alterations that individual unit-owners add after the original installation. Coverage continues to apply for damage to items that were part of the initial installation or items that replaced those initial items if they were of similar quality to the initial installation items.

BP 0319–Condominium Loss Assessment Coverage

This endorsement should be attached to any policy that covers a condominium unit-owner. It covers the named insured's share of a loss assessment that the condominium association charges to all unit-owners. A deductible and limit must be entered on the endorsement schedule for each unit insured.

BP 0321–Ordinance or Law Extension

This endorsement covers destruction of undamaged property, removal of its debris, and increased costs of construction due to enforcing municipal or other governmental codes, ordinances, and laws that apply to construction and reconstruction that follows a covered loss.

BP 0322–Computer Coverage

(Use with BP 0100)

This endorsement covers computers for risks of direct physical loss or damage, except for losses otherwise excluded or limited. Premises/Building Numbers and limits for hardware and software must be entered on the endorsement schedule. The coverage it provides is similar to the coverage BP 0200–Businessowners Special Policy provides.

BP 0323–Seasonal Increase

This endorsement is used to increase business personal property limits for the time periods on the endorsement schedule.

Note: It is very important to consider the seasonal increase that the Businessowners Policy provides automatically under How Much We Pay when selecting the appropriate limit for this endorsement.

BP 0324–Fine Arts Coverage

This endorsement insures articles of fine art listed, described, and that have a limit of insurance on the endorsement schedule. It provides limited automatic coverage for fine arts acquired during the policy period. It removes many of the Businessowners Policy exclusions but adds exclusions that are specific to fine arts that must be reviewed carefully. Valuation is based on the limits for art objects listed and described on the endorsement schedule.

BP 0325–Sprinkler Leakage Earthquake Extension

This endorsement is used when sprinkler leakage that an earthquake causes is the only earthquake coverage desired.

BP 0327–Spoilage Coverage

This endorsement covers loss or damage to perishable stock or merchandise caused by the perils of breakdown and contamination and/ or power disruption for the limit(s), perils, and deductible(s) on the endorsement schedule.

BP 0330–Water Backup and Overflow Coverage

This endorsement buys back the part of the water exclusion that excludes overflow and backup of sewer, drains, sump pumps, and similar equipment. It can be used for direct damage and/or for loss of income. Coverage applies at locations and for the type of property, coverage(s), and limits on the endorsement schedule.

BP 0331–Protective Devices

This endorsement is a warranty that the protective devices on the endorsement schedule will be in proper working condition at all times. A credit is provided for such devices. If they are not working at the time when an otherwise covered fire or theft loss occurs, there is no coverage for that loss.

BP 0332–Earthquake and Volcanic Eruption Coverage

This endorsement insures loss or damage to covered property that earthquake and volcanic eruption causes. This is not the same as the earth movement exclusion. This endorsement removes only the earthquake and volcanic eruption portion of that exclusion. Coverage applies to all covered locations because the endorsement does not have a schedule.

BP 0333–Non-Owned Auto Liability Coverage/Hired Auto Liability Coverage

This endorsement extends the Businessowners Policy's bodily injury and property damage liability coverages under Coverage L to apply to non-owned and/or hired auto situations listed on the endorsement schedule.

BP 0334–Additional Insured–Townhouse Associations

This endorsement is used when the named insured is a townhouse association. It extends the policy's liability coverage to include each unit-owner as an insured. That coverage is limited to only such liability imposed because the unit-owner is a member of the townhouse association. It does not insure the individual unit-owners' personal liability.

BP 0336–Premium Payments

The endorsement is used when the insurance company issues a policy with a term of more than one year. It notifies the named insured that the company will recalculate the premium at each anniversary date. The company will also add any new and revised policy forms and endorsements at the same time.

BP 0338–Condominium Association Coverage

This endorsement should be attached to policies that cover condominium association. It covers fixtures, improvements, and alterations that are part of a unit and personal property that all unit-owners own indivisibly. All property coverage is primary and there are no rights of recovery against unit-owners. Each unit-owner is an insured but only with respect to communal areas. Certain limitations and additional conditions apply.

BP 0343–Functional Replacement Cost Valuation–Business Personal Property

Insuring some property at full replacement cost could create a significant moral hazard and significantly increase the named insured’s premium. This endorsement lets the named insured select the amount of coverage needed to replace the property on the endorsement schedule with functionally equivalent property.

BP 0345–Functional Replacement Cost Valuation–Buildings

Insuring some buildings at full replacement cost could create a significant moral hazard and significantly increase the named insured’s premium. This endorsement lets the named insured select the amount of coverage needed to replace the building on the endorsement schedule with a functionally equivalent building.

BP 0346–Change Endorsement

This endorsement is used to make miscellaneous changes to the policy that other endorsements cannot do. These changes should not involve coverage or premium considerations.

BP 0348–Theft Exclusion

(Use with BP 0200)

This endorsement excludes loss caused by theft of business personal property. Ensuing losses that a specified peril causes are covered. However, it does not exclude pillaging or looting that takes place when the civil commotion or riot takes place.

BP 0350–Condominium Unit-Owners Coverage

This endorsement deletes Coverage B–Business Personal Property in the Businessowners Policy and replaces it with language that applies specifically to condominiums. It must be used when the named insured is a condominium unit-owner.

BP 0351–Property Additional Coverage Endorsement (01 15 change)

This endorsement provides certain additional coverages and limits for property additional coverages, extensions of coverage, and optional coverages to the basic Businessowners Policy. Each can be purchased separately but this endorsement provides the coverages for a single premium charge instead of charging for each one separately. It also adds spoilage coverage. The coverages and limits are on the endorsement schedule. The business personal property – off premises limit was increased from $10,000 to $15,000 in the 01 15 change.

BP 0355–Windstorm or Hail Percentage Deductibles

This endorsement provides a percentage deductible approach to windstorm or hail loss or damage to covered property at locations on the endorsement schedule. The rules specify that the percentage options available are 1%, 2%, or 5%. The minimum deductible is $1,000 per occurrence.

BP 0370–Data Compromise Expense Coverage

This endorsement is a buyback for some of the computer data coverage the Businessowners Policy excludes. It provides three types of coverage in a prescribed manner for the benefit of employees, clients, and other designated insureds whose personal information was compromised.

BP 0499–Additional Insured–Grantor of Franchise

This is liability only endorsement covers a franchiser as an additional insured but only for liability that arises because the franchisor granted a franchise to the named insured.

BP 0605–Expanded Non-Owned Auto Liability Coverage/Hired Auto Liability Coverage

This endorsement is identical to BP 0333–Non-Owned Auto Liability Coverage/Hired Auto Liability Coverage with two changes:

BP 0623–Employment Practices Liability–Claims-Made Basis

This endorsement adds Coverage F–Employment Practices Liability. It has its own coverage description, definitions, exclusions, and other conditions.

BP 0639–Employment Practices Liability–Extended Reporting Period

This endorsement is used when the named insured purchases the three-year extended reporting period specified in BP 0623–Employment Practices Liability–Claims-Made Basis. It provides an additional limit of insurance for claims made during the reporting period.

BP 0650–Equipment Breakdown

This endorsement covers equipment breakdown on boilers and other types of machinery.

BP 0661–Utility Service Disruption–Property Damage

This endorsement was previously named Utility Interruption–Property Damage. It covers loss or damage to covered property that occurs because a covered specific utility service or services to locations on the endorsement schedule is disrupted. A covered peril must cause the disruption of utility service.

BP 0662–Utility Services Disruption–Time Element

This endorsement was previously named Utility Interruption–Time Element. It covers loss of earnings and extra expenses incurred because a disruption of covered listed utility service or services to locations on the endorsement schedule. A covered peril must cause the disruption.

BP 0676–Exclusion–Fungus or Related Perils

This endorsement excludes liability coverage for losses that result from direct or indirect contact with fungus or related perils. It has exceptions for specific food producing risks, farm workers and for losses due to slippery surfaces because a fungus or related peril exists or is present.

BP 0677–Exclusion–Fungus or Related Perils–Contracting Operations

This endorsement excludes liability coverage for injury or damage due to contact with fungus or related perils when coverage is written on contracting operations. It does not have any exceptions.

BP 0678–Exclusion–Exterior Installation and Finish Systems

This endorsement excludes liability coverage for injury or damage due to any aspect of an Exterior Insulation and Finish System (EIFS).

BP 0679–Limited Coverage for Loss by Wet Rot, Dry Rot, Bacteria, Fungi, or Protists

This endorsement can be used in place of BP 0676–Exclusion–Fungus or Related Perils. It provides limited coverage for damages the named insured must pay for bodily injury or property damage that result from any contact with fungus or related perils. It has exceptions for specific food producing risks and farm workers. An occurrence limit and an aggregate limit must be entered on the endorsement schedule.

BP 0680–Exclusion–Damage to Work Performed by the Insured or on the Insured's Behalf

This endorsement deletes and replaces the Damage to Your Work exclusion in the Businessowners Policy. The wording is identical, except that it removes the exception for work done by subcontractors.

Note: This exclusion is much more restrictive than the exclusion in the Businessowners Policy.

BP 0681–Exclusion–Damage to Work Performed by the Insured or on the Insured's Behalf–Designated Locations or Projects

The endorsement is identical to BP 0680–Exclusion–Damage to Work Performed by the Insured or on the Insured's Behalf except that the restriction applies to only locations or projects on the endorsement schedule. This means that the Damage to Your Work exclusion in the policy applies to all other locations and projects.

BP 0701–Additional Insured–Co-Owner of the Insured Premises

This endorsement includes the co-owner on the endorsement schedule as an additional insured but only with respect to its liability as a co-owner of the premises on the endorsement schedule.

BP 0702–Additional Insured–Controlling Interest

This endorsement adds the party on the endorsement schedule as an insured. Coverage applies for only its liability due to its control, maintenance, or ownership of the scheduled premises that the named insured leases or occupies or its financial control of the named insured.

BP 0703–Additional Insured–Mortgagee, Assignee, or Receiver

This endorsement adds the party on the endorsement schedule as an insured but only for its liability because of its interest in the listed premises as a mortgagee, assignee, or receiver.

BP 0704–Additional Insured–State or Political Subdivisions–Premises Permits

This endorsement adds the state or political subdivision on the endorsement schedule as an additional insured. This is only with respect to premises that the named insured owns, controls or has rented to it for which the agency or subdivision issued a permit. It applies only for the hazards described.

BP 0708–Additional Insured–Vendors

This endorsement adds the vendor on the endorsement schedule as an additional insured but for only for the liability that arises from the products listed on the endorsement schedule. The products must be considered the named insured’s products and the vendor must handle, sell, or distribute the products.

BP 0709–Additional Insured–Concessionaires Trading Under the Insured's Name

This endorsement adds the concessionaires on the endorsement schedule as additional insureds but only for the products/completed work hazard. Coverage is limited liability because they are concessionaires that trade under the named insured's name.

BP 0711–Loss Payable Options

This endorsement applies to property coverage. It establishes the rights, requirements, and conditions for loss payments to loss payees, lenders' loss payees, and parties to a contract of sale.

BP 0713–Builders' Risk–Completed Value

This endorsement covers buildings under construction that are listed on the endorsement schedule. The limit of insurance entered should be 100% of the building's projected completed value. This coverage is similar to the coverage that Builders’ Risk Coverage Forms provide.

BP 0715–Installation Tools and Equipment

Tools and equipment owned by the named insured and similar property of others are covered by this endorsement based on the entered description and subject to the limit of insurance. Limited coverage applies for employee tools, newly acquired property, and rental reimbursement.

BP 0716–Installation Floater

The named insured's property at jobsites is covered for the limits of insurance scheduled on this endorsement. Coverage applies anywhere the named insured is working and the coverage provides additional coverages, exclusions, and conditions. This coverage is similar to the coverage that Installation Floaters or Coverage Forms provide.

BP 0717–Increased Restoration Period–Ordinance or Law

This endorsement extends the restoration period for loss of income coverage to include the time period needed to comply with building ordinances or laws. It should be added whenever BP 0321–Ordinance or Law Extension that is attached to extend coverage for direct damage losses.

BP 0718–Pharmacists' Professional Liability Coverage – Broad (01 15 change)

This endorsement provides professional liability coverage for bodily injury, property damage, or personal and advertising injury that arises because the named insured or its employees either provided or failed to provide professional services as a pharmacist but only those within the definition of a retail pharmacy practice and only if done in connection with the named insured business.

The term broad used in this endorsement distinguishes it from BP 0821–Pharmacists’ Professional Liability Coverage – Limited. This 01 15 edition of this endorsement is actually less broad than the prior edition because it defines exactly what the policy considers professional services and specifically excludes all compounding. Volunteers are no longer covered and negligent hiring, training, and supervising is a new exclusion.

BP 0719–Optical and Hearing Aid Establishments (01 15 change)

This endorsement provides professional liability coverage for bodily injury, property damage, or personal and advertising injury that arises because the named insured or its employees either provided or failed to provide professional health care services that meet the definition of an optical or hearing aid practice and only if done in connection with the named insured business. This 01 15 edition is less broad than the prior edition because it defines exactly what the policy considers professional services and specifically no longer include actions of volunteers. Negligent hiring, training, and supervising is a new exclusion.

BP 0720–Liability Exclusion (Applying to all Hazards in Connection with Designated Premises, Operations, or Products)

This endorsement excludes all liability for bodily injury, property damage, and personal and advertising injury that arises out of the ownership, maintenance, or use of the designated premises or operations on the endorsement schedule.

Note: This endorsement should be used only when those operations or premises are insured elsewhere because this endorsement and others like it are frequently challenged when a major incident occurs.

BP 0721–Barbers’ and Hair Stylists' Liability (01 15 change)

The name of this endorsement changed from Cosmetologists’ to Barbers’ and Hair Stylists’ Liability. This endorsement provides professional liability coverage for bodily injury, property damage, or personal and advertising injury that arises because the named insured or its employees either provided or failed to provide professional barber and hair stylist services in connection with the named insured business.

This 01 15 edition is less broad than the prior edition because it defines exactly what the policy considers professional services and specifically no longer include actions of volunteers. It also specifically excludes electrolysis, hair implants, tanning, dying/coloring of eyebrows and lashes, and wax hair removal services. Negligent hiring, training, and supervising is a new exclusion.

BP 0722–Punitive Damages Exclusion

This endorsement excludes punitive, exemplary, or vindictive damages under all liability coverages.

BP 0723–Employee Redefined

This endorsement redefines employee. It removes leased workers as employees but only with respect to exclusion k., Workers Compensation, under bodily injury and property damage liability. This means this exclusion does not apply to leased employee so that if a leased worker is injured while he or she performs duties for the named insured and sues the named insured, coverage may apply provided no other exclusion would apply. All other uses of the term employee as used elsewhere in the policy continue to include leased workers as employees. This could be useful when the contract between the named insured and its leased employee provider requires that the provider cover workers compensation benefits.

BP 0725–Contractual Liability Limitation

This endorsement limits contractual liability coverage to only the five covered contracts or agreements listed on the endorsement. It eliminates the Businessowners Policy’s broad definition of covered contracts.

BP 0726–Deletion–Coverage P–Personal and Advertising Injury Liability

This endorsement deletes Coverage P–Personal and Advertising Injury.

BP 0727–Leased Premises Limitation

This endorsement changes the definition of covered contract with respect to leases of premises to include only the lease for the premises on the endorsement schedule and its adjoining ways.

BP 0728–Coverage E–Employee Benefits Liability Coverage–Claims-Made Basis

This endorsement covers damages due to injuries to employees caused by the named insured’s negligent act, error, or omission committed in administering an employee benefit program.

BP 0729–Coverage E–Employee Benefits Liability Coverage–Supplemental Extended Reporting Period

This endorsement establishes the provisions for the Supplemental Extended Reporting Endorsement for Employee Benefits Liability coverage. It is used when the named insured decides to purchase the extended reporting period detailed in BP 0728–Coverage E–Employee Benefits Liability Coverage–Claims-Made Basis. This is an unlimited time extension and provides an additional limit of insurance for claims made during the reporting period.

BP 0730–Expanded Coverage for Property Damage to Rented Premises

This endorsement broadens coverage for property damage for which the named insured is legally liable to apply to the premises on the endorsement schedule. It applies only if it rents the premises from the owner or occupies the premises with the owner's permission. It eliminates the more limited Coverage O–Fire Legal Liability and short term rented premises coverages. It eliminates most property damage exclusions for the scheduled premises. As a result, it provides almost first-party type coverage for the property except that it covers only damages for which the named insured is legally liable. The limit per occurrence on the endorsement schedule is subject to the policy aggregate limit.

BP 0731–Waiver of Subrogation

This endorsement applies to only the products/completed work hazard. It waives the insurance company’s rights of recovery against the party(ies) or organization(s) on the endorsement schedule. The waiver applies to such injury or damage that arises out of the named insured's ongoing work or work it does under contract for that party or organization.

BP 0732–Veterinarians' Professional Liability Coverage (01 15 change)

This endorsement provides professional liability coverage for bodily injury, property damage, or other injury that arises because the named insured or its employees either provided or failed to provide professional services as a veterinarian. This 01 15 edition has changed from acts, errors or omissions coverage to bodily injury, property damage or personal and advertising injury resulting from professional services performance or denial. Negligent hiring, training, and supervising is a new exclusion.

BP 0733–Printers' Errors and Omissions Liability (01 15 change)

This endorsement covers liability for other injury caused by named insured’s negligent acts, errors, or omissions that result from its printing services. Coverage applies to only printing services that are provided by the named insured’s business. It does not apply to willful acts, plagiarism, copyright infringement, reimbursement of printing costs, and various other exposures.

BP 0734–Lead Liability Exclusion

This is a mandatory endorsement in some states but not in others. It excludes liability for bodily injury, property damage, and personal and advertising injury that arises out of any form of lead.

BP 0735–Self-Storage Warehouses

This endorsement customizes the Businessowners Policy for self-storage warehouse. It limits coverage by excluding customers' property. It extends loss of income coverage to include loss of income from renting space. It includes employee theft of customer property if employee dishonesty coverage is provided. It also provides Customers’ Property Legal Liability Coverage and liability coverage for lockout, sale, removal, or disposal of property.

BP 0736–Exclusion–Abuse or Molestation

This endorsement excludes bodily injury, property damage, or personal and advertising injury due to the actual or threatened abuse or molestation of anyone who is in an insured's care, custody, or control. There is also no coverage when allegations are made that the named insured improperly managed the person who allegedly committed the abuse or in the way it responded to such actions or allegations.

BP 0737–Deletion–Volunteer Workers (01 15 change)

This endorsement deletes all references to volunteer workers as insureds in the Businessowners Policy’s liability coverages.

Note: Minor editorial changes were made to make the changes better fit the 06 12 editions of the BP 100 and BP 200.

BP 0738–Newly Acquired Organizations

This endorsement was previously Additional Insured–Newly Acquired Organizations. It adds the named insured's newly acquired or formed organizations as named insureds but only if the named insured that acquires it has majority interest in them. It does not apply to joint ventures, partnerships, or limited liability companies.

BP 0739–Deletion–Coverage M–Medical Payments–Designated Classification or Premises

This endorsement deletes Coverage M–Medical Payments for the scheduled classification or premises location on the endorsement schedule. It provides first aid supplementary coverage as a substitute.

BP 0741–Funeral Directors' Professional Liability Coverage (01 15 change)

This endorsement provides professional liability coverage for bodily injury, property damage, or personal and advertising injury that arises because the named insured or its employees either provided or failed to provide professional services that meet the definition of a funeral director and only if done in connection with the named insured business. This 01 15 edition is less broad than the prior edition because it defines exactly what the policy considers a funeral director and no longer adds mental anguish to the definition of bodily injury. Negligent hiring, training, and supervising is a new exclusion.

BP 0742–Expanded Liquor Liability Exclusion

This endorsement restricts coverage. It adds two additional activities that would make an operation subject to the to the liquor liability exclusion. It applies to any entity that furnishes or serves alcoholic beverages for a charge or when the liquor serving activity requires a license.

Note: Because this exclusion was not changed with the BP 0816 change the exclusions for negligence in hiring and for acts in omission in transportation are not part of this exclusion which makes is slightly broader. However, it also does not include the explanation regarding alcohol bringing brought onto premises. It would appear that this not being updated was an oversight.

BP 0743–Expanded Liquor Liability Exclusion–With Exception for Designated Activities (01 15 change)

This endorsement is identical to BP 0742–Expanded Liquor Liability Exclusion except that it does not exempt any activity on the endorsement schedule from the liquor liability exclusion.

Note: The only change is that the BP 0816 liquor changes are incorporated into this endorsement. It does not change the intent of the endorsement, but it does match the current liquor exclusion wording.

BP 0744–Customers' Auto Legal Liability Coverage–Care, Custody or Control Exception

This endorsement is similar to Garagekeepers Legal Liability Coverage. It covers damages an insured is legally obligated to pay due to property damage to a customer's vehicle while in its care, custody, or control for service, repair, attending, storing, or parking. It is subject to the limits and deductible on the endorsement schedule.

BP 0745–Pollution Exclusion–With Exception for a Short-Term Pollution Event  

This endorsement amends the pollution exclusion to cover short-term pollution events that begin at an identified place during the policy period and completely end at a precise time not more than 48 hours later. As a condition of coverage, the named insured must inform the insurance company of the event as soon as possible but not more than 14 days after it ends.

BP 0746–Pollution Exclusion–With Exception for Designated Pollutants

This endorsement amends the pollution exclusion by adding an exception. Coverage applies to injury or damage that arises from use of the pollutants listed on the endorsement schedule. However, coverage applies only if the named insured uses the pollutants as part of its operations. Coverage does not apply to the same pollutants when they are transported, handled, stored, treated, disposed of, processed as waste, or transported or stored for others.

BP 0747–Aggregate Limits of Insurance per Location

This endorsement changes the General Aggregate Limit to apply separately to each location that the named insured owns or rents as the endorsement defines location.

BP 0748–Total Pollution Exclusion

This endorsement removes all exceptions in the pollution exclusion.

BP 0749–Total Pollution Exclusion–With Exceptions for Building Equipment and Hostile Fire

This endorsement was previously named Total Pollution Exclusion–With Exceptions for Heating Equipment and Hostile Fire. It is identical to BP 0748–Total Pollution Exclusion except that it does not apply to bodily injury or property damage that arises from heat, smoke, or fumes from a hostile fire or fumes or vapor from heating, cooling, or dehumidifying equipment, or equipment to heat water.

BP 0751–Limited Pollution Liability Extension

This endorsement amends the pollution exclusion to provide coverage at premises or jobsites, except with respect to underground tanks. The coverage provided is subject to the 12-month aggregate limit on the endorsement schedule.

BP 0752–Limited Fungus and Related Perils Coverage–Changes

This is a property endorsement. It lets the named insured select a higher Limited Fungus and Related Perils Aggregate Limit. It is also used to amend the 30-day time limit that applies to Fungus and Related Perils under Loss of Income Coverage Extensions. Revised limits and time periods are entered on the endorsement schedule.

BP 0753–Amendment of the Definition of Covered Contract

This endorsement amends the definition of covered contract to delete coverage for an additional insured's sole negligence. Coverage applies only if the named insured or another party that acts for the named insured causes the bodily injury or property damage.

BP 0797–Exclusion – Data Breach Liability - Personal and Advertising Injury (01 15 addition)

This endorsement can be used in place of mandatory BP 0798. It excludes only personal and advertising injury loss due to data breach liability which means that bodily injury and property damage losses are covered. An additional premium is required when this endorsement is used.

BP 0798–Exclusion – Data Breach Liability (01 15 addition)

This is a mandatory endorsement. It must be attached to all policies except when the BP 0797 above is purchased. The disclosure of confidential information is excluded as is damage of any kind to data records.

BP 0811–Cosmetic Damage Exclusion – Roofing Materials (01 15 addition)

This exclusion applies only for damage to roof materials caused by windstorm or hail. All coverage for damage that is considered as only cosmetic is excluded. Such damage is covered only if the property is unable to stop the entrance of rain, hail, or other elements.

BP 0812–Elimination of Insurance-To-Value (01 15 addition)

The requirement that the limit of insurance for a property must be 80% of its replacement cost at the time of loss for the replacement cost valuation to apply is eliminated in its entirety when this endorsement is attached.

BP 0813–Contaminated Food Coverage (01 15 addition)

When a food contamination incident happens, immediate action is required. This endorsement pays the costs of the clean-up and the testing and vaccinating of employees. It also pays for the earnings that are lost, starting 24 hours after the event, and the cost of the food that must be destroyed. Once the named insured is ready to return to operations, an advertising campaign may be needed to encourage customers to return so this coverage also pays for the costs of such a campaign.

BP 0814–Amendatory Endorsement – Motels (01 15 addition)

This endorsement is mandatory for any motel risk. The named insured’s interest in property of others in its care custody or control is excluded.  However, a new liability coverage is added that provides up to $25,000 coverage for guests’ property. In addition, coverage for property of the named insured in the guest rooms is added as is limited lock replacement.

BP 0815-Liability Coverage for Motel Guest’ Property in Safe Deposit Box (01 15 addition)

This endorsement applies only to motels. It provides coverage for property of guests that are placed in safety deposit boxes that are not assessable to the public and not in the guests’ room. This is liability coverage and most liability exclusions continue to apply.  

BP 0816–Policy Amendatory Endorsement (01 15 addition)

BP 0817–Processing or Production Operations Exclusion – Rental Units (01 15 addition)

This is a mandatory endorsement for any policy issued to a tenant or to an owner of rental units. Any damage that is the result of a substance being released in a processing or production operation is excluded. While this was developed because of “meth-labs” it is a far-reaching endorsement that applies to any such damage and regardless of whether the production or processing is legal and whether the production or processing was agreed to in the lease.

BP 0818–Roofing Materials – Actual Cash Value Loss Settlement (01 15 addition)

The valuation section of the policy is revised to list roofing material as subject to actual cash value valuation and not to replacement cost. This valuation applies regardless of the peril.

BP 0819–Windstorm or Hail Losses to Roofing Material – Actual Cash Value Loss Settlement (01 15 addition)

This is identical to BP 0818 above except that it applies only when the peril causing the loss is windstorm or hail.

BP 0820–Windstorm or Hail Exclusion (01 15 addition)

This endorsement excludes loss due to windstorm or hail in their entirety. The only exception is when the windstorm or hail results in a covered peril. The damage from that covered peril would be covered but not the hail or windstorm damage.

BP 0821–Pharmacists’ Professional Liability Coverage – Limited (01 15 addition)

This is a more limited version of the BP 0718–Pharmacists' Professional Liability Coverage – Broad endorsement. It provides professional coverage for only the handling or selling of drugs and providing of vaccinations. No other pharmacist services are covered. 

BP 0822–Salon Services’ Liability Coverage (01 15 addition)

This endorsement provides liability coverage for bodily injury, property damage, or other injury that arises because salon services were rendered or failed to be rendered. Salon services is a very narrow band of services usually provided by barbers and hairstylists. Cutting, conditioning, dyeing, shampooing, shaving, styling, and trimming of hair are the only services covered. Negligent hiring, training, and supervising excluded.

BP 0838–Silica Exclusion

This endorsement defines silica and excludes all liability exposures of silica and silica-related dust.

BP 0839–Asbestos Exclusion

This endorsement excludes coverage for liability exposures associated with asbestos and asbestos-related products.

BP 0841–Additional Insured–Designated Person or Organization

This endorsement adds the person or organization named in the schedule as an additional insured. Coverage applies only if the named insured’s acts or omissions that relate to its premises or ongoing work in any way caused the injury or damage. Actions or omissions by a party that acts on the named insured’s behalf that relate to the named insured’s premises, ongoing work, or other designated interests are also covered.

BP 0842–Additional Insured–Lessor of Leased Equipment

This endorsement is used to provide liability coverage for the organization or person that leases equipment to the named insured. Coverage applies only for injury or damage that the named insured causes by maintaining, operating, or using the leased equipment in any way.

BP 0843–Additional Insured–Engineers, Architects, or Surveyors

This endorsement adds any engineer, architect, or surveyor the named insured engages as an insured. Coverage applies only if the named insured’s acts or omissions that relate to its premises or ongoing work in any way caused the injury or damage. Actions or omissions by a party that acts on the named insured’s behalf that relate to the named insured’s premises, ongoing work, or other designated interests are also covered. Professional services are not covered.

BP 0844–Coverage C–Loss of Income–Without a Waiting Period (01 15 changes)

This endorsement eliminates the 72-hour waiting period for the restoration period to begin after direct physical loss or damage with respect to Loss of Income Coverage. It also removes the 72-hour waiting period with respect to the Interruption of Civil Authority Coverage Extension and the Earnings from Dependent Locations coverage.

Note: The changes in the 01 15 edition are editorial to match the changes introduced in the BP 0816.

BP 0845–Additional Insured–Lessor of Premises

The endorsement adds the entity on the endorsement schedule as an additional insured but only as lessor of the premises listed on the endorsement schedule that the named insured leases. Coverage applies to only the named insured’s liability for damages because of injury or damage that its acts or omissions cause. This also includes acts or omissions of others who work on the named insured’s behalf for the part of the premises the party leases to the named insured.

BP 0847–Coverage C–Loss of Income–Ordinary Payroll Limitation

This endorsement is used to limit ordinary payroll expense to the number of days on the endorsement schedule. It is also used to list exemptions for specific employees or job classifications.

BP 0848–Additional Insured – Building Owner (01 15 addition)

This is a property endorsement that can be used to designate the building owner scheduled on the endorsement as an additional insured. It requires that any property loss be adjusted with both the named insured and the building owner. 

BP 0858–Exclusion–Communicable Disease

This endorsement excludes direct or indirect bodily injury, property damage, or personal and advertising injury due to the alleged or actual transmission of communicable diseases by people, an insured's property and products, or property of others in its care, custody, or control. It also excludes loss, cost, or expenses due to any requirement that results from communicable diseases or conditions attributed to those diseases.

BP 0859–Exclusion–Communicable Disease–Limited Products Exception

This endorsement is identical to BP 0858–Exclusion–Communicable Disease except that it does not apply to the alleged or actual transmission of a communicable disease by any product intended for consumption by, or to be topically applied to, animals or humans.

BP 0868–Cross Liability Exclusion–Injury to Certain Insureds

This is a liability endorsement. It is used to exclude bodily injury and personal and advertising injury to the insureds that receive their status as insureds based on the type of business listed on the declarations.

Note: This means that there is no coverage if a partner sues another partner or if a stockholder sues an executive officer.

CL 0342–Equipment Breakdown Reinstatement

This endorsement is used with Equipment Breakdown optional coverage. It reinstates coverage for the described equipment at the location on the endorsement schedule that was suspended because it was in (or exposed to) a dangerous condition or situation.
